Tel-Aviv attorney Nitsana Darshan-Leitner has condemned Israel's General
Security Service (Shin Bet) over its refusal to come to the aid of accused
collaborator Allan Bani-Odeh who was executed by the Palestinian Authority
this afternoon. Bani-Odeh and another alleged collaborator, Magdi Mikkawi,
were charged by the Palestinians with assisting Israel in its campaign to
assassinate suspected terrorist leaders operating from within the Palestinian
Authority. Mikkawi was also executed today.
At the time of Allan's arrest last month, Darshan-Leitner wrote to Palestinian
Justice Minister Freih Abu Medein demanding the right to represent Allan at
his trial in Nablus. Abu Medein responded to Darshan-Leitner assuring her
that he would take her request under serious consideration. The Nablus
Court, however, swiftly went forward with its proceedings and sentenced
Allan to death after a two hour trial.
Allan was convicted of giving his cousin, Hamas bombmaker lbrahim Bani-
Odeh a car that had been booby trapped with explosives by Israel's Shin Bet.
lbrahim was blown up in the vehicle on a crowded Nablus street. Allan was
arrested shortly afterwards by the Palestinian police.
In the wake of the short trial, attorney Darshan-Leitner sent a letter to the
head of the Shin Bet, Avi Dichter, insisting that the security service take
immediate action to save the life of Bani-Odeh. The Shin Bet denied that
Bani-Odeh was its agent and that Israel was engaged in an official campaign
to assassinate Palestinian terrorists. This past week, however, the Israeli
government has finally acknowledged that it does indeed have a policy of
killing suspected terrorist. Despite this, the Shin Bet failed to undertake any
steps to save the life of Bani-Odeh.
According to Darshan-Leitner: "These agents endangered their lives in
Israel's war against Palestinian terrorist operating from the P.A. When these
agents are captured the Shin Bet must do for them, exactly as the
government would do for any of its soldiers taken prisoner on any battlefield
by any of its enemies. The Shin Bet simply abandoned Bani-Odeh to the
Palestinian security forces. Despite all the high-level meetings being
conducted between Israel and the P.A., the fate of Shin Bet agent Bani-Odeh
was never placed on the agenda nor made a priority.
"The Palestinian Justice Minister assured me that either myself or another
attorney from the P.A. would be allowed to represent Bani-Odeh in the court
hearing and that he would receive a fair trial. Yet, Bani-Odeh was sentenced
to death in a capital crime proceeding that took only a few hours and in
which he had no right of appeal. Hamas activist stood outside the courtroom
door and chanted 'Death to Bani-Odeh.' Now the world can see that the P.A.
is a 'banana republic" with a brutal Justice system that completely
disregards human rights. One must wonder where are the international
organizations like Amnesty International, Middle East Watch and B'Tselem,
which made no effort at all to save Bani-Odeh?"

Council on Foreign Relations January 8, 2001 Opening remarks
Thank you Les and the Council on Foreign Relations, and hello to everyone
who is on the line with us today. I am so pleased to be able to participate
with you from Jerusalem. Thank you for inviting me to give the Leffingwell
Lecture, and to share my views on Israel's engagement in the peace process,
as well as our policies in recent weeks and months.
At Camp David we were able, for the first time, to touch on the most
sensitive issues of all. Israeli willingness to negotiate far-reaching
understandings was not reciprocated. Arafat avoided the discussion, choosing
to respond to President Clinton's ideas with a thank-you letter.
The recent clashes began on September 28, 2000, three days after a dinner
with Chairman Arafat at my home, and one day after the conclusion of a round
of negotiations in Washington. At the end of these negotiations, both sides
had arrived at a tacit understanding of the American view of a possible
agreement. But, the Palestinian side wanted to try, as we say, and squeeze
the lemon one more time.
President Clinton's ideas of December 23, 2000, served an historic purpose:
for the first time a proposal for a quid pro quo agreement on Permanent
Status was put on the negotiating table. Both sides were closer than ever to
an agreement.
Israel announced that it would be willing to view these ideas as a basis for
discussion provided that they become the basis for discussion also for the
Palestinians. However, Arafat dragged his feet for ten days, rendering the
achievement of an agreement almost impossible.
Ladies and Gentlemen,
The entire Middle East is at a crossroads. Whatever is not achieved in the
near future, might not be achieved for a long time. In the absence of an
agreement, all sides may face uncertainty, instability and the mutual
challenge of avoiding a deterioration in the situation.
My government endorses the position expressed in the joint statement at the
end of the Camp David Summit: that neither party should take unilateral
steps. We expect the international community to make known its opposition to
unilateral actions pertaining to the status of the West Bank and Gaza Strip,
and to the permanent status of the outstanding issues.
On the other hand, peace offers Israel, the Palestinians and the entire
region the prospect of stability, prosperity and growth.
The Palestinian people, who could establish their own state in the West Bank
and the Gaza Strip with Al-Quds as its Capital, would be able to determine
their own fate. The fifty-three year plight of the refugees could be
resolved and a new future within reach.
Israel would have internationally recognized borders, recognition of
Yerushalaim as its capital, and 80% of the settlers incorporated within
sovereign Israeli territory. We would have lasting security arrangements,
as well as other mechanisms to ensure stability.
The leading role, commitment and dedication of the United States, and that
of President Clinton personally, remain essential for the successful
conclusion of the FAPS.
Both sides face historic decisions. Our mission is to win the support of our
people for the settlement of this 100-year conflict, and to guarantee
regional stability and growth. We should be partners in this mission --
members of an alliance of peace -- each with the duty to respect the
concerns and needs of the other.
I am confident that Israel will remain committed to the process of peace
based on the frameworks agreed in Madrid, Oslo, and Sharm El-Sheikh. We are
determined to achieve agreement on all out-standing issues relating to the
Permanent Status, which, according to the letter that Chairman Arafat sent
to Prime Minister Rabin on September 9, 1993, should only be resolved
through negotiations.
Without question, a permanent agreement would place the Zionist Movement on
the verge of a new and exciting phase in its evolution. But, more
importantly, it would offer an horizon of opportunities for both the Israeli
and the Palestinian people. All of us in this region deserve a better and
more secure future.
On this positive note, I will be happy to accept your questions.

MOMENT TO REVIEW SOME OF THE DEVELOPMENTS THAT LED US TO WHERE WE ARE

THE EVOLUTION OF THE ARAB-ISRAEL CONFLICT PARALLELS THE CREATION, AND
ULTIMATE COLLISION, OF TWO SEPARATE NATIONAL MOVEMENTS: THAT OF THE
JEWISH PEOPLE AND THAT OF THE PALESTINIAN PEOPLE.
OUR JEWISH HISTORICAL TRADITION INCORPORATES STRONG TIES TO THE LAND
OF ISRAEL AND A LONG MEMORY OF POLITICAL AND PHYSICAL DESTRUCTION
THROUGHOUT THE AGES.
THE BIRTH OF THE STATE OF ISRAEL REPRESENTS FOR THE JEWISH PEOPLE THE
TRIUMPH OF AN ANCIENT DREAM OF INDEPENDENCE OVER CENTURIES OF
VICTIMIZATION WITHOUT OUR HOMELAND.
SINCE ITS INCEPTION IN THE 19TH CENTURY, THE JEWISH NATIONAL MOVEMENT
- THE ZIONIST MOVEMENT - HAS BEEN A POLITICAL MOVEMENT.
ZIONISM, FOR THE MOST PART, FAVORED VIABLE AND PRAGMATIC POLITICAL
OPTIONS OVER RISKY MILITARY CAMPAIGNS.
WE HAVE ALWAYS ACKNOWLEDGED THE SIGNIFICANCE OF INTERNATIONAL
RECOGNITION AND LEGITIMACY.
MOREOVER, ON THE BASIS OF SHARED DEMOCRATIC VALUES AND ETHICS, WE
ALLIED OURSELVES WITH THE BRITISH EMPIRE IN WORLD WAR I, WITH THE
ALLIES IN WORLD WAR II, AND, ABOVE ALL, WITH THE UNITED STATES OF
AMERICA. THIS POLITICAL WISDOM, COUPLED WITH THE UNIQUE STRENGTH OF
OUR PEOPLEHOOD, ARE THE TRUE SECRETS OF OUR OUTSTANDING SUCCESS.
IN 1967, IN A CAMPAIGN OF SELF-DEFENSE AND LAST RESORT, ISRAEL
ACHIEVED AN ASTOUNDING MILITARY VICTORY.
THE CONTINUATION OF OUR CONTROL OVER THESE TERRITORIES GRADUALLY
BROUGHT INTO QUESTION THE ETHICAL FOUNDATION OF OUR STATE:
WE COULD NOT RECONCILE OUR LIBERAL DEMOCRATIC VALUES WITH THE REALITY
THAT WAS CREATED THROUGH OCCUPATION OF THE WEST BANK AND THE GAZA
STRIP.
IN 1993, LATE PRIME MINISTER RABIN MADE AN HISTORIC, STRATEGIC
DECISION TO CHOOSE THE PATH OF A SMALLER ISRAEL, IN KEEPING WITH TRUE
JEWISH VALUES OF HUMANISM AND SOCIAL EQUALITY, AS WELL AS ENSURING A
FUNDAMENTAL JEWISH DEMOGRAPHY AND CHARACTER. PRIME MINISTER RABIN
BROUGHT US BACK TO THE VERY HEART OF THE ZIONIST MOVEMENT.
SINCE THEN, ISRAEL'S STRATEGIC OBJECTIVE HAS BEEN TO CREATE AN
INTERNATIONALLY RECOGNIZED POLITICAL REALITY IN WHICH ISRAEL
DISENGAGES ITSELF FROM THE PALESTINIANS.
FOR THIS PURPOSE WE HAVE CONCLUDED MORE THAN TEN AGREEMENTS AND
PROTOCOLS WITH THE PLO, FROM THE GAZA-JERICHO AGREEMENT TO THE WYE
RIVER MEMORANDUM.
THESE UNDERSTANDINGS WERE BASED ON ONE SIMPLE CONCEPT: DURING A
FIVE-YEAR INTERIM PERIOD, AN INFRASTRUCTURE OF PALESTINIAN
INSTITUTIONS WOULD BE ESTABLISHED IN ORDER TO ASSUME RESPONSIBILITY
OVER THE TERRITORY AND PEOPLE THAT WOULD BE TRANSFERRED TO THEIR
CONTROL.
IT WAS OUR HOPE THAT AT THE END OF THIS INTERIM PERIOD, MUTUAL
CONFIDENCE WOULD HAVE GROWN, AND WE WOULD HAVE BEEN IN A MUCH BETTER
POSITION TO ADDRESS THE DIFFICULT CORE ISSUES RESERVED FOR THE
NEGOTIATIONS ON THE PERMANENT STATUS AGREEMENT.
THESE ISSUES INCLUDE JERUSALEM, SETTLEMENTS, BORDERS, REFUGEES, AND
SECURITY.
UNFORTUNATELY, THE REALITY WAS DIFFERENT.
WHILE ISRAEL GRADUALLY TRANSFERRED TERRITORIES TO THE PALESTINIAN
SIDE, THE PALESTINIANS FAILED TO PREPARE ITS PUBLIC FOR THE KIND OF
CONCESSIONS THAT WOULD BE NECESSARY IF A PERMANENT STATUS AGREEMENT
WAS TO BE ACHIEVED.
IN THE WYE RIVER MEMORANDUM, THE NETANYAHU-SHARON GOVERNMENT
CONTINUED THIS DANGEROUS PATH OF GRADUAL TRANSFER OF TERRITORIES WITH
NO PROGRESS ON THE PERMANENT STATUS ISSUES.
THAT GOVERNMENT WASTED 3 YEARS, AND OFFERED THE REGION NO ALTERNATIVE
FRAMEWORK FOR THE POLITICAL PROCESS.
AT THE SAME TIME, WE WITNESSED AN UNPRECEDENTED UPGRADE IN THE STATUS
OF THE PALESTINIAN AUTHORITY TO THE POINT OF BECOMING A QUASI-STATE;
AND, THE INTRODUCTION, FOR THE FIRST TIME, OF A VIABLE,
INTERNATIONALLY-RECOGNIZED PALESTINIAN ALTERNATIVE TO THE PROCESS OF
DIALOGUE AND NEGOTIATION: THE UNILATERAL DECLARATION OF STATEHOOD.
LADIES AND GENTLEMEN,
SINCE ITS INCEPTION, MY GOVERNMENT HAS BEEN DETERMINED TO MAKE EVERY
EFFORT TO ACHIEVE AN AGREEMENT OF LASTING AND SECURE PEACE WITH THE
PALESTINIANS, AND TO BRING THIS AGREEMENT TO A NATIONAL REFERENDUM OF
THE ISRAELI PEOPLE.
IN JULY 1999, WHEN MY GOVERNMENT TOOK OFFICE, TWO STAGES OF THE WYE
RIVER MEMORANDUM HAD NOT BEEN IMPLEMENTED, AND THERE WAS NO AGREED
FRAMEWORK FOR NEGOTIATIONS.
IN ADDITION, THE PALESTINIAN SIDE HAD RAISED THE OPTION OF UDI IN THE
ABSENCE OF NEGOTIATIONS, AND THERE WAS NO WAY OF ASSESSING
PALESTINIAN EXPECTATIONS FROM THE PERMANENT STATUS AGREEMENT.
WE HAD TO DESIGN A NEW FRAMEWORK FOR THE POLITICAL PROCESS.
THIS WAS THE SHARM MEMORANDUM, CONCLUDED ON SEPTEMBER 4, 1999,
WHEREBY WE AGREED THAT ISRAEL AND THE PLO WILL FIRST NEGOTIATE THE
FRAMEWORK AGREEMENT ON PERMANENT STATUS (FAPS), FOLLOWED BY THE
COMPREHENSIVE AGREEMENT ON PERMANENT STATUS (CAPS).
THOSE TWO AGREEMENTS WOULD CONSTITUTE THE PERMANENT STATUS AGREEMENT.
THE MEMORANDUM INCORPORATED THE INTERDEPENDENCE BETWEEN THE THIRD
FURTHER REDEPLOYMENT AND PERMANENT TERRITORIAL ARRANGEMENTS.
THE UNDERLYING LOGIC OF THE SHARM MEMORANDUM WAS THAT ALL ISSUES
RESERVED FOR THE PERMANENT STATUS NEGOTIATIONS ARE INTERRELATED, AND
THAT NO SINGLE ISSUE CAN BE ISOLATED. THIS MEMORANDUM PUT AN END TO
THE GRADUAL TRANSFER OF TERRITORY WITHIN INTERIM ARRANGEMENTS, AND
OPENED THE WAY FOR ADDRESSING THE ISSUES RESERVED FOR THE PERMANENT
STATUS AGREEMENT.
IT IS IMPORTANT TO RECALL HERE THAT THE 1993 DECLARATION OF
PRINCIPLES, IN ITS PREAMBLE, STATES THAT THE PARTIES "...AGREE THAT
IT IS TIME TO PUT AN END TO DECADES OF CONFRONTATION AND CONFLICT
..." OTHER AGREEMENTS CONTAIN SIMILAR LANGUAGE.
THIS IS MOST RELEVANT AS IT UNDERSCORES OUR PRIMARY POLITICAL AND
LEGAL OBJECTIVE: THAT THE FAPS WILL ACTUALLY CONSTITUTE THE END OF
THE
ISRAELI-PALESTINIAN CONFLICT AND WILL BRING ABOUT A FINALITY OF
CLAIMS. THIS, MY FRIENDS, IS THE CORNERSTONE OF OUR ENGAGEMENT IN
PERMANENT STATUS NEGOTIATIONS.
THE DECLARATION REGARDING THE END OF THE CONFLICT IS, FIRST AND
FOREMOST, A POLITICAL STATEMENT. ITS MESSAGE IS CLEAR: AS OF THIS
MOMENT WE NO LONGER DEFINE THE STATE OF OUR RELATIONS AS "IN
CONFLICT," BUT RATHER AS "IN PEACE" OR "IN GOOD NEIGHBORLY
RELATIONS".
THE ISSUE OF "FINALITY OF CLAIMS" HAS FAR-REACHING LEGAL
IMPLICATIONS.
WE EXPECT THE FAPS TO IDENTIFY AND RESOLVE ALL ISSUES REGARDING
CLAIMS THAT EITHER PARTY HAS AGAINST THE OTHER.
IN PRACTICAL TERMS FOR ISRAEL, THE END OF CONFLICT MEANS AN
ACCEPTABLE RESPONSE TO ISRAELI SECURITY CONCERNS; PALESTINIAN
RECOGNITION OF YERUSHALAIM AS THE CAPITAL OF ISRAEL; TERMINATION OF
THE PALESTINIAN REFUGEE ISSUE; AND A PALESTINIAN COMMITMENT TO THE
PEACEFUL SETTLEMENT OF ALL DISPUTES.
WE ARE CONVINCED THAT THIS REPRESENTS NOT ONLY FAIR, GOOD-FAITH
EXPECTATIONS, BUT ALSO THE ONLY WAY TO FULLY INSURE THE
IMPLEMENTATION OF THE AGREEMENT.
AT THE SAME TIME, WE HAD TO CONFRONT ANOTHER CHALLENGE, NAMELY THE
PALESTINIAN STRUCTURE OF DECISION-MAKING.
ARAFAT IS THE SOLE DECISION-MAKER AND DOES NOT DISCLOSE HIS QUID PRO
QUO TO ANY OF HIS NEGOTIATORS. EACH PALESTINIAN NEGOTIATOR HAS A
DIFFERENT QUID PRO QUO.
PUT TOGETHER IN THE SAME ROOM, THIS IS A RECIPE FOR IMPASSE.
FURTHERMORE, ARAFAT HAS NEVER MADE A MAJOR POLITICAL DECISION WITHOUT
EXPLORING ALL POLITICAL AND MILITARY OPTIONS.
A ROUND OF VIOLENCE BEFORE THE CONCLUSION OF AN AGREEMENT WAS FULLY
ANTICIPATED.
THEREFORE, WE KNEW THAT IN THE FINAL PHASES WE WOULD HAVE TO BRING
THE PROCESS, AS MUCH AS POSSIBLE, TO THE POINT WHERE ARAFAT, HIMSELF,
COULD NOT AVOID MAKING DECISIONS.
AT CAMP DAVID WE WERE ABLE, FOR THE FIRST TIME, TO TOUCH ON THE MOST
SENSITIVE ISSUES OF ALL.
ISRAELI WILLINGNESS TO NEGOTIATE FAR-REACHING UNDERSTANDINGS WAS NOT
RECIPROCATED.
ARAFAT AVOIDED THE DISCUSSION, CHOOSING TO RESPOND TO PRESIDENT
CLINTON'S IDEAS WITH A THANK-YOU LETTER.
THE RECENT CLASHES BEGAN ON SEPTEMBER 28, 2000, THREE DAYS AFTER A
DINNER WITH CHAIRMAN ARAFAT AT MY HOME, AND ONE DAY AFTER THE
CONCLUSION OF A ROUND OF NEGOTIATIONS IN WASHINGTON.

UNDERSTANDING OF THE AMERICAN VIEW OF A POSSIBLE AGREEMENT.
BUT, THE PALESTINIAN SIDE WANTED TO TRY, AS WE SAY, AND SQUEEZE THE
LEMON ONE MORE TIME.
PRESIDENT CLINTON'S IDEAS OF DECEMBER 23, 2000, SERVED AN HISTORIC
PURPOSE: FOR THE FIRST TIME A PROPOSAL FOR A QUID PRO QUO AGREEMENT
ON PERMANENT STATUS WAS PUT ON THE NEGOTIATING TABLE. BOTH SIDES WERE
CLOSER THAN EVER TO AN AGREEMENT.
ISRAEL ANNOUNCED THAT IT WOULD BE WILLING TO VIEW THESE IDEAS AS A
BASIS FOR DISCUSSION PROVIDED THAT THEY BECOME THE BASIS FOR
DISCUSSION ALSO FOR THE PALESTINIANS.
HOWEVER, ARAFAT DRAGGED HIS FEET FOR TEN DAYS, RENDERING THE
ACHIEVEMENT OF AN AGREEMENT ALMOST IMPOSSIBLE.
LADIES AND GENTLEMEN,
THE ENTIRE MIDDLE EAST IS AT A CROSSROADS. WHATEVER IS NOT ACHIEVED
IN THE NEAR FUTURE, MIGHT NOT BE ACHIEVED FOR A LONG TIME.
IN THE ABSENCE OF AN AGREEMENT, ALL SIDES MAY FACE UNCERTAINTY,
INSTABILITY AND
THE MUTUAL CHALLENGE OF AVOIDING A DETERIORATION IN THE SITUATION.
MY GOVERNMENT ENDORSES THE POSITION EXPRESSED IN THE JOINT STATEMENT
AT THE END OF THE CAMP DAVID SUMMIT:
THAT NEITHER PARTY SHOULD TAKE UNILATERAL STEPS.
WE EXPECT THE INTERNATIONAL COMMUNITY TO MAKE KNOWN ITS OPPOSITION TO
UNILATERAL ACTIONS PERTAINING TO THE STATUS OF THE WEST BANK AND GAZA
STRIP, AND TO THE PERMANENT STATUS OF THE OUTSTANDING ISSUES.
ON THE OTHER HAND, PEACE OFFERS ISRAEL, THE PALESTINIANS AND THE
ENTIRE REGION THE PROSPECT OF STABILITY, PROSPERITY AND GROWTH.
THE PALESTINIAN PEOPLE, WHO COULD ESTABLISH THEIR OWN STATE IN THE
WEST BANK AND THE GAZA STRIP WITH AL-QUDS AS ITS CAPITAL, WOULD BE
ABLE TO DETERMINE THEIR OWN FATE. THE FIFTY-THREE YEAR PLIGHT OF THE
REFUGEES COULD BE RESOLVED AND A NEW FUTURE WITHIN REACH.
ISRAEL WOULD HAVE INTERNATIONALLY RECOGNIZED BORDERS, RECOGNITION OF
YERUSHALAIM AS ITS CAPITAL, AND 80% OF THE SETTLERS INCORPORATED
WITHIN SOVEREIGN ISRAELI TERRITORY.
WE WOULD HAVE LASTING SECURITY ARRANGEMENTS, AS WELL AS OTHER
MECHANISMS TO ENSURE STABILITY.
THE LEADING ROLE, COMMITMENT AND DEDICATION OF THE UNITED STATES, AND
THAT OF PRESIDENT CLINTON PERSONALLY, REMAIN ESSENTIAL FOR THE
SUCCESSFUL CONCLUSION OF THE FAPS.
BOTH SIDES FACE HISTORIC DECISIONS. OUR MISSION IS TO WIN THE SUPPORT
OF OUR PEOPLE FOR THE SETTLEMENT OF THIS 100-YEAR CONFLICT, AND TO
GUARANTEE REGIONAL STABILITY AND GROWTH.
WE SHOULD BE PARTNERS IN THIS MISSION -- MEMBERS OF AN ALLIANCE OF
PEACE -- EACH WITH THE DUTY TO RESPECT THE CONCERNS AND NEEDS OF THE
OTHER.
I AM CONFIDENT THAT ISRAEL WILL REMAIN COMMITTED TO THE PROCESS OF
PEACE BASED ON THE FRAMEWORKS AGREED IN MADRID, OSLO, AND SHARM

SHOULD ONLY BE RESOLVED THROUGH NEGOTIATIONS.
WITHOUT QUESTION, A PERMANENT AGREEMENT WOULD PLACE THE ZIONIST
MOVEMENT ON THE VERGE OF A NEW AND EXCITING PHASE IN ITS EVOLUTION.
BUT, MORE IMPORTANTLY, IT WOULD OFFER A HORIZON OF OPPORTUNITIES FOR
BOTH THE ISRAELI AND THE PALESTINIAN PEOPLE.
ALL OF US IN THIS REGION DESERVE A BETTER AND MORE SECURE FUTURE.
ON THIS POSITIVE NOTE, I WILL BE HAPPY TO ACCEPT YOUR QUESTIONS.

Hundreds of Palestinians, including leading Palestinian Authority and Fatah
officials, conducted a hate-filled rally against Israel on Friday, complete
with a donkey clad in a tallit [Jewish prayer shawl, known as a Jewish
religious symbol all around the world] treading over a swastika-adorned
Israeli flag.
The hatred - which was manifest in Ramallah, the city in which two Israeli
soldiers were brutally lynched three months ago - also featured the burning
of an Israeli flag, speeches against Clinton's bridging proposals, and
calls not to give up on the "right of return" or Jerusalem. Afterwards,
some of the demonstrators made their way to the northern entrance of the
city, where they began shooting at IDF soldiers and attacking them with
large rocks.
2. P.A. EXECUTES COLLABORATORS
Yesterday's two executions by the Palestinian Authority of collaborators
with Israel place the PA, Israel's General Security Service, and
international human rights' organizations such as Amnesty and B'Tselem in
a
bad light. So say some Israeli legal sources today. Allan Bani-Odeh and
Magdi Mikkawi were executed by the Palestinians for assisting Israel in the
assassination of terrorist leaders. The executions took place in Gaza and
Shechem, in front of cheering crowds of thousands. Tel Aviv attorney
Nitsana Darshan-Leitner, who volunteered to represent one of yesterday's
two executed Palestinians last month, says that the sentence was handed
down after only a two-hour trial; "the world can now see that the PA is a
'banana republic' with a brutal justice system that completely disregards
human rights."
"Where are the international organizations like Amnesty International,
Middle East Watch and B'Tselem," questioned Darshan-Leitner, "which
made no
effort at all to save Bani-Odeh?" This morning, B'Tselem director Eitan
Fellner condemned the executions - but said that he sees no difference
between them and the recent Israeli policy of targeting and killing
Palestinian terrorist leaders. "The Israelis are trying to prevent
terrorist attacks," he said, "while the Palestinians are trying to prevent
cooperation with Israel in what they consider terror against the
PA." Prime Minister Barak condemned the PA executions, saying that they
are reminiscent of "dark periods in history."
Atty. Leitner said that after she wrote to the GSS asking it to take
immediate action to save Bani-Odeh, the organization denied that he was a
GSS agent. "These agents endangered their lives in Israel's war against
Palestinian terrorists," she said today, "and when these agents are
captured, the GSS must do for them whatever it would do for any of its
soldiers taken prisoner on the battlefield by any of its enemies. The GSS
simply abandoned Bani-Odeh to the Palestinian security forces." The PA
has
announced that additional executions will take place this week.
Israel Resource News Agency reports that Voice of Palestine radio reported
prominently on the executions of the two men convicted of "cooperation"
with Israel. IRNA notes that, "This is the only use of 'cooperation' in
the context of Israel that has been heard on Palestinian radio," despite
the current efforts supposedly being made for "security cooperation" with
Israel. Palestinian human rights organizations reported to Israel's
Channel Two last night that Arafat's regime has assembled a list of more
than 20,000 Palestinians who are slated for execution for working for Israel.
A committee of Arab supporters of Israel - branded as collaborating
traitors by Palestinians - has petitioned the Supreme Court to order the
government to cut off all ties with the Palestinian Authority. The reason
given for the suit: the executions by the PA of collaborators with
Israel. The committee states that the executions are in violation of the
Oslo accords, and places many collaborators in mortal danger.
3. ATTACKS CONTINUE DESPITE "SECURITY COOPERATION"
Despite the renewed "security cooperation" efforts between the PA and
Israel, Palestinians shot at Israeli targets in at least four locations
last night: A Border Guard patrol near Tulkarm, Ofer Base near Ramallah,
and Gadid and N'vei Dekalim in Gush Katif. The shooting occurred while
Shimon Peres was meeting with Yasser Arafat in Gaza. Peres reported on
the
lack of results from his talks at today's Cabinet meeting; Foreign Minister
Shlomo Ben-Ami and Atty. Gilad Sher also reported on their similarly dull
talks with Palestinian leaders. Minister Amnon Lipkin-Shachak and GSS
head
Avi Dichter were to represent Israel at yet another high-level
Israeli-Palestinian meeting originally scheduled for tonight; the
Palestinians announced late this afternoon, however, that they would not
attend. Other contacts between the sides continued throughout the day.
Hevron was the site of several severe incidents over the Sabbath. On
Friday afternoon, Arabs hurled an explosive device at soldiers behind Beit
Hadassah; soldiers who came to investigate were attacked by an Arab with a
pistol, whom they shot and killed. On Friday night, Arab terrorists shot
at four different targets simultaneously from the Abu Sneineh hills. The
targets included a large group of men, women and children walking home
from
the Machpelah Cave; a resident of the Avraham Avinu neighborhood inside a
building; a nearby army base; and an army roadblock near the Machpelah
Cave. No one was hurt. The next day, Arabs hurled cement blocks at
soldiers in Hebron, and last night, Arabs threw an explosive device at
soldiers above the Avraham Avinu neighborhood.
In the southern Jerusalem neighborhood of Gilo, a woman was stabbed in her
back late this morning, and was transferred to Hadassah Ein Karem Hospital
in moderate condition. The attacker escaped toward Palestinian
territory. A grenade was thrown at an IDF outpost on the Israeli-Egyptian
border today; no one was hurt. Shots were fired over the Sabbath at Psagot.
4. "THE TEMPLE MOUNT IS THE HEART"
Rabbi Yehuda Amital, co-Rosh Yeshiva of Yeshivat Har Etzion and leader of
the left-wing religious party Meimad, likens the possibility of giving away
the Temple Mount to a Torah law for which one should "be killed and not
violate." Makor Rishon newspaper reports that during his Tenth of Tevet
lecture to his students nine days ago, Rabbi Amital said,
"Just like the life of an individual is not the supreme value, and there
are prohibitions [such as idol worship] which we are commanded to uphold
even at the expense of our lives, so too in our national life there are
values for which the society and the state must place itself in danger. In
our national life, there are issues that are 'red lines,' for which we must
'be killed and not violate.'" Giving up our sovereignty on the Temple
Mount can be thought of as one of these, Rabbi Amital said, adding that a
society that places the sanctity of life above every other single value,
"will deteriorate to ethical corruption. Peace, too, no matter how
important it is, is not the sole supreme value, and there are things which
we may not give up even for peace." He also said that giving away the
Temple Mount would lead to the detachment of masses of Jews from their
Judaism, as it would be a break from "historic Judaism."
Health Minister Roni Milo, of the Center Party, handed in his resignation
from the government today. His resignation letter states that as early as
July, during the Camp David talks, he said that he would not be able to
serve in a government that would agree to give up the Temple Mount.
Popular protests against the government's policies continue. Women in
Green stood outside the Cabinet meeting this morning, chanting, "Only
Three
Weeks Left for this Government of Blood."... A convoy of cars from Pisgat
Ze'ev - the northern Jerusalem neighborhood that is threatened with
isolation and encirclement under the Clinton/Barak Jerusalem plan, and
where a firebomb was thrown Friday night - set off for the Prime Minister's
home last night. Close to 100 cars joined in the spontaneous
protest... At the Furedis Junction in the Haifa/Zikhron Yaakov area, a
rally was held under the theme, "The Temple Mount is the Heart." ...
5. EXPLAIN THAT, PLEASE?
The Supreme Court has still not handed down a ruling on the question of a
minority government conducting diplomatic negotiations. Three suits
against the holding of such talks were heard on Friday, but the Justices
said that it could not proceed with the case until the State Attorney's
representative made its position clearer. Atty. Osnat Mandel of the State
Prosecution had said that though Barak is allowed to conduct such talks, he
must do so with "the proper caution." The Court instructed her to clarify
the legal significance of the term "proper caution." No date has been set
for the next Court session.
6. U.S. COURT DENIES POLLARD'S ATTORNEY ACCESS TO SECRET
DOCUMENTS
The District Court of Columbia ruled on Friday that Jonathan Pollard's
attorney, Eliot Lauer, who has top-secret level security clearance, may not
see the classified portion of the Pollard docket - as it would pose a
national security risk. The court dismissed Pollard's attorney's assertion
that he has a "pressing need to see the documents" - despite Pollards'
explanation that government officials routinely cite those very portions as
the reason Pollard should never be released. Pollard supporters note that
any President who chooses to consider pardoning Pollard now or in the
future will have to rely only on the documents' interpretation provided by
those government agencies that adamantly oppose his release.
Pollard supporters also note that the ruling continues to prevent Pollard's
attorneys from challenging the false charges contained in the Weinberger
Memorandum. Since he was sentenced in 1987, none of Pollard's
security-cleared attorneys has ever been allowed access to the Weinberger
document in order to challenge it in a court of law or to refute it within
the clemency process. Again, the ruling means that American presidents
will continue to see the Weinberger document interpreted by one side only -
those opposed to clemency for Jonathan Pollard.
A separate motion filed by Pollard in the same court and before the same
judge is up next; it seeks to vacate the sentence on grounds that his
previous attorney failed in his representation - even neglecting to appeal
the life sentence that Pollard received in a blatant breach of his plea
agreement.
7. WHY TRAVEL TO ISRAEL?
The United States State Department renewed its warning to its citizens
yesterday, advising them to refrain from visiting Israel or the areas under
the control of the PA. In this connection, Arutz-7 received a letter from
a reader at "rsscpa2929@aol.com" of Sharon, Massachusetts, excerpts of
which appear below:
Dear Friends,
Recently my family and I went to Israel (Dec. 19-31). I would like to
share some of our experiences with you and my thoughts on the travel
there... When we got to Jerusalem, we were initially nervous and cautious
everywhere we went or walked. It eventually appeared to be safe, but we
were fairly resigned that we would not be able to visit the Kotel (Western
Wall)... Eventually, it seemed safe enough, that absolutely nothing was
happening in Jerusalem, other than in the territories, settlements, and
Arab areas of the Old City, that we decided to go to the Kotel. This, too,
from a safety standpoint, became a non-event... We subsequently went to
the Kotel several other times and stopped worrying as we walked. There
was
just nothing happening in the areas we were likely to be visiting. We also
hired a guide for three days and went all over the Galil (north). The
guide took us through the extreme north right to the border with Lebanon
and showed us where the situations were more tense. We went through the
Golan Heights, along the borders with Syria and Jordan, visited Rosh
Hanikra and some of the very northern kibbutzim and towns, everywhere
wholly without event. We also, on returning, drove on the highways on
which some of the more pro-Palestinian, Israeli Arab towns had been
agitating, blocking traffic and participating in some of the stonings of
Israeli troops. Well, by the time we were there, this activity had
completely ceased and driving through also became a non-event. We had a
completely wonderful trip, enjoyed having our whole family together for
such a good time and blew lots of money as tourists - happily, since it was
Israel... If you were otherwise planning a visit or otherwise predisposed
to go to Israel, don't cancel the visit for safety concerns. Go. It is
completely routine everywhere, outside of the obvious areas you would
logically avoid. We all are huge and outspoken supporters and donors of
and to Israel. This is the time Israel needs the support, not in cash
sent, but in cash spent. You can also enjoy yourself in the process...
"We were in a large restaurant called Decks in Tiberias. The restaurant
was relatively full, but all with Israelis; we were the only tourists. At
one point, they turned off the lights in the restaurant, a waitress came
over to our table with desserts with sparklers shooting out of them, and an
announcement came over the loudspeaker, "We would like to welcome our
friends from Boston. We thank them for coming to visit Israel at this very
difficult time for our country." If you think that simple act was not an
emotional experience, you don't understand the connection between yourself
and Israel."
8. PALESTINIANS HOLDING AND TORTURING TWO ISRAELI-ARABS
Palestinian security forces have been detaining two Israeli-Arabs from the
Be'er Sheva region for a number of weeks. The PA claims that the two had
planned to transfer ownership of properties to Jews. Kol Rina News Agency
reports that the two Israeli-Arabs are being tortured, and that Israel is
not taking action on their behalf. A senior military officer told Kol Rina
that he is interested in leaking the story to the press, "as that will be
the only chance we have of saving them."
9. YAHALOM FOR SHARON
Shas and Likud party leaders met this afternoon for a campaign-strategy
planning session. Cooperation between the two parties on behalf of Ariel
Sharon's Prime Ministerial campaign has been lame thus far. The election
will be held on Feb. 6th. Earlier today, Sharon met with National
Religious Party faction head MK Sha'ul Yahalom. Yahalom told Arutz-7
afterwards, " Sharon told me unequivocally that he would never agree to a
division of Jerusalem, nor to a withdrawal from the Jordan Valley, and that
all the settlements will remain in place because he sees all of them as
being in necessary security zones." Yahalom added a word of caution: "I
would advise all my friends on my [political] right not to press Sharon too
hard, and allow him some room for vagueness - after all, we don't want only
the right-wing to vote for Sharon, we want also some of the center..."
Asked if thought that there was a possibility of war breaking out if Sharon
wins, Yahalom said, "I think that there is a greater possibility of such if
Barak remains Prime Minister - because if he doesn't reach an agreement,
then the Palestinians will wage war, but if he does reach an agreement,
then our security will be as weak as if there was a war - even IDF Chief of
Staff Mofaz says the agreement as currently formulated is very dangerous
for Israel..."

today. They are protesting against the insistence of the Barak
transition/minority government on conducting negotiations with the
Palestinians while Palestinian violence continues. The strikers met today
with President Moshe Katzav. They said they are "seriously considering"
Chief Rabbi Yisrael Meir Lau's request that they end their strike...

1. New Egyptian spy trial opens
(BNI-JAN.14) The trial of Sharif al Filali, 34, opened in an Egyptian
court on Saturday. The defendant stands accused of espionage for the State
of Israel. The state accuses him of supplying intelligence information to
Israel=92s Mossad Intelligence Agency.
Israeli citizen Azam Azam remains in an Egyptian prison after he was found
guilty of espionage against Israel and the US, despite formal statements
from both governments that Azam was not acting as an agent.
Despite pleas for a pardon to Egyptian President Hosni Mubarak by former
President Ezer Weizman and others, Azam remains imprisoned under
reportedly harsh conditions.=20=20

2. Peres=92 Erez meeting fails to yield results
(BNI-JAN.14) The Saturday night meeting between Minister Shimon Peres=20
and
PA Chairman Yassir Arafat in Gaza failed to yield significant results
according to reports from government officials.
The prime minister remains tenacious in his efforts to reach any type of
=91agreement=92 in the final week of the Clinton administration and is work=
ing
to show a significant reduction in daily attacks before the February 6
elections in Israel.
Commentators pointed out that at this critical hour, Mr. Barak opted to
place his nemesis Shimon Peres at the head of the negotiations, removing
the most senior official to date, Foreign Minister Shlomo Ben-Ami, in the
hope of securing a deal in the coming days.

3. Mevo Ofra and Beit El outpost ordered closed down
(BNI-JAN.14) The IDF Battalion Commander in the Benjamin Regional Council
of Samaria, Colonel Hirsh served the residents of new encampments near
Ofra and Beit El with orders to immediately evacuate the areas.
The new encampments were established following the murders of Rabbi
Binyamin Ze=92ev and Talia Kahane in a terrorist attack in the area on

5. Firebomb attack in Jerusalem
(BNI-JAN.14) A firebomb was hurled at a home in Jerusalem=92s Armon=20
HaNatziv
neighborhood late Saturday night, landing on a balcony of a home on Meir
Dakar Street. There were no injuries in the attack.
Clothing on a clothes line on the balcony caught fire but firefighters
were able to extinguish the blaze before any significant damages were
caused.
There have been several firebomb attacks in the same area over past weeks.

aide Danny Yatom on Sunday is scheduled to visit Jordan to meet with King

the realization that the days of the current administration appear to be

Neve Dekalim, in Gush Katif Gaza, were attacked by gunfire. There were no

(BNI-JAN.14) The IDF=92s Ofer base, west of the PA autonomous city of
Ramallah, in Samaria, was attacked by gunfire at about 7:00pm Saturday

10. Fatah calls for continuation of =91Intifada=92
(BNI-JAN.14) The Supreme Council of the Fatah terror organization over the
weekend called for a continuation of the daily attacks known as the
=91Intifada=92.
Following a meeting of the leadership of the terror organization aligned
with PA Chairman Yassir Arafat, it was decided that the daily attacks
would continue. Among the senior PA officials to address the assembly was
senior negotiator Dr. Saeb Erekat, who plays a pivotal role in the ongoing
Oslo process between Israel and the PA. Erekat briefed the participants on
the status of talks between Israel and the PA.
Fatah leaders explained there would be no compromise on key issues such=20
as
demands for a total Israeli withdrawal to the pre-June 1967 boundaries,
which would entail a total retreat from the eastern portion of Jerusalem,
the Old City and Western Wall, Temple Mount, all of Judea, Samaria, Gaza,
the Jordan Valley and the Golan Heights. Fatah leaders also rejected
compromise on the demands for the right of return for so-called
Palestinian refugees.=20=20

11. Israeli travelers stripped of weapons by PA military forces
(BNI-JAN.14) A group of Israelis that took a wrong turn and landed out at
a PA military checkpoint were disarmed and released by the PA military
troops at that location.
One vehicle occupied by four residents of the community of Maale Shomron
on Saturday made an incorrect turn and found themselves at a PA military
checkpoint near Shchem (Nablus), in northern Samaria. They explained what
had happened but were immediately stripped of their weapons and then told
to leave the area.=20
Following the Israelis filing a report with authorities, an IDF District
Coordinating Office made a formal request that the two weapons be
immediately returned. There were compliance with the request in less than
an hour.
Officials in the IDF=92s Judea & Samaria Command Headquarters explained tha=
t
the PA is well aware that the current days are being viewed as a =91trial
period=92 by the government of Israel, explaining the unusually prompt
compliance with the demand for the immediate return of the weapons.=20=20

12. Firebomb attack in northern Jerusalem on Saturday evening
(BNI-JAN.14) A firebomb was thrown at a home in northern Jerusalem on
Saturday night. There were no injuries in the attack that occurred on
Eliyahu Meridor Street in the northern Jerusalem neighborhood.=20
The incendiary device did ignite near the entrance of the building but
there was no report of damages. Police are investigating.=20=20

13. Tanzim terrorist killed by IDF forces in Hebron on Friday
(BNI-JAN.14) During unrests in the city on Friday, IDF forces shot and
killed Tanzim terrorist Shaker Hassouni who was armed with a pistol at the
time. Arabs who were participating in the clashes reported that Hassouni
was unarmed, contradicting the reports of soldiers and commanders at the
scene.=20
The Office of the IDF Spokesman added that the victim had thrown a
homemade explosive device at soldiers, prompting them to open fire.=20

14. Soldier wounded in stone-throwing attack at Ayosh Junction on Friday
(BNI-JAN.14) An IDF soldier sustained light injuries in a stone-throwing
attacks at Ayosh Junction in Samaria on Friday afternoon during clashes
with residents of the nearby PA autonomous city of Ramallah.=20=20
The soldier was transported to a Jerusalem hospital for treatment.
Soldiers were also attacked by gunfire on Friday afternoon at Ayosh. There
were no injuries.=20=20

15. Police attacked with stones following Friday Islamic services in
capital
(BNI-JAN.14) Following Friday prayer services on the Temple Mount, some of
the 30,000 Islamic worshipers attacked Israeli security forces. There were
no reported injuries.

16. PA executes two for collaborating with Israeli security services
(BNI-JAN.14) Despite outcries from human rights organizations, the PA on
Saturday executed two persons found guilty of having cooperated with
Israeli security services. Majdi Makawi, 27, and Alam Bani Odeh, 25, were
killed by firing squad after a PA court found them guilty as charged of
having furnished Israeli security agents with information that led to the
assassination of senior terrorist leaders.
Senior PA officials stated the executions were to serve as a loud and
clear message to anyone contemplating cooperating with Israeli security
officials. PA Chairman Yassir Arafat personally signed the execution
orders.
Prime Minister Ehud Barak is coming under increasing criticism for what
many are calling the abandonment of Arabs who in the past played a vital
role in furnishing Israel=92s intelligence network with information that le=
d
to the apprehension of many terrorists as well as the prevention of terror
attacks.=20=20
The PA-appointed mufti of the Temple Mount stated that one who betrays his
people to assist the enemy must be sentenced to death in accordance to
Islamic law.

(BNI-JAN.14) Two roadside explosive devices were detonated on the
el-Hader bypass road in the Bethlehem area of Judea on Friday night. There

19. Worshipers attacked by gunfire returning from Sabbath prayers
(BNI-JAN.14) Hebron community residents were attacked by gunfire from four
directions on Friday night as they returned from Sabbath prayer services
to their homes in the Jewish Quarter of the City.
Community spokesperson Noam Arnon expressed outrage over the latest
attack, pointing out that it was nothing short of a miracle that no one
was killed or injured. He repeated calls to the government to take the
appropriate actions to ensure the safety of Jewish residents of the city.

1. Cabinet Secretary Herzog continues to defy police inquiry
(BNI-JAN.14) Cabinet Secretary Yitzhak Herzog continues to maintain his
silence, refusing to cooperate with the ongoing police investigation into
alleged illegal campaign funding pertaining to the Bark for prime minister
campaign in 1999.
Herzog was questioned by police once again on Friday, for two hours.
According to Israel Radio reports, he once again maintained his silence,
refusing to cooperate with the police investigation.=20
Earlier last week, a petition was filed with the High Court of Justice
calling for Herzog=92s dismissal =96 explaining that it was unacceptable fo=

senior civil servant to interfere with a police investigation. The High
Court has instructed the state to explain why Herzog should not be removed

2. Knesset Speaker Burg supports hunger strikers
(BNI-JAN.14) Knesset Speaker Avraham Burg of the Labor Party on Friday
visited the Safra Square hunger strikers that are protesting the policy of
concessions to the PA by the Barak administration.
Chief Rabbi Yisrael Meir Lau has called upon the strikers, leaders and
supporters of the Professor for a Strong Israel organization, to cease
their life-threatening action. They told Rabbi Lau that his request would
be given serious consideration.

3. No Israelis among fatalities in El Salvador earthquake
(BNI-JAN.14) According to Israeli diplomatic officials, the powerful
earthquake in El Salvador, in Central America, did not claim the lives of
Israeli citizens according to embassy records of Israelis in the country.
The quake registered 7.6 on the Richter scale and is believed to have
claimed hundreds of lives. Ambassador Arieh Tzur added the Israeli
diplomatic compound escaped damage in the powerful quake that last for
about twenty seconds.
The IDF=92s Home Front Command, working in conjunction with Ministry of the
Interior, is preparing a planeload of emergency aid that will include a
field hospital, medicine and rescue equipment.
In the past, the Home Front search and rescue team comprised of specially
trained personnel working with dogs, have successfully extricated quake
victims from under rubble in many areas.=20=20

4. IDF chaplain under fire for preventing women from praying
(BNI-JAN.14) An IDF Nahal Brigade chaplain has come under fire for
preventing women affiliated with the Conservative Movement from praying in
a base synagogue with phylacteries, worn only by men according to=20
Orthodox
law.
The women stated they did offer to remain in the women=92s section of the
synagogue but that too was deemed unacceptable by the chaplain.
The leaders of the Conservative Movement in Israel have decried the
actions of the chaplain, demanding religious freedom for all in Israel,
including those in the military.=20=20

5. America issues another travel warning to its citizens
(BNI-JAN.14) The government of the United States over the weekend issued a
travel advisory to its citizens, warning of dangers associated with
visiting Israel and the region.
The US Department of State warning referred to recent terrorist attacks,
advising citizens to refrain from visiting Israel or the areas under the
control of the PA.
For those visiting Israel, they are advised to be increasingly cautious
while at shopping centers, public buses, commercial centers and other
areas deemed prime targets for terrorists.=20=20
In a related matter, US diplomatic officials attached to the embassy and
consulate in Israel are banned from using public transportation in Israel.
They are also banned from entering the Old City of Jerusalem or visiting
eastern Jerusalem commercial centers.
MKs Anat Maor (Meretz), Mossi Raz (Meretz) and Yosef Paritzky (Shinui)
called for religious freedom for all in the military.=20

6. Armored corps soldiers shoots up southern base
(BNI-JAN.14) A soldier serving in the IDF=92s armored corps on Saturday
stole a heavy machinegun from an armory and began shooting up the base.
Soldier Dimitri Feldman, a =91lone soldier=92 and recent immigrant from the
Ukraine, stole the weapon and began shooting while riding a forklift. He
eventually turned himself over to authorities after about three hours.
There were no injuries in the shooting spree. The soldier was taken into
custody and will undergo psychiatric evaluation.=20=20

7. Israeli attorney condemns GSS over abandonment of informant
(BNI-JAN.14) Tel Aviv attorney Nitsana Darshan-Leitner has condemned
Israel=92s General Security Service (GSS/Shin Bet) over its refusal to come
to the aid of accused collaborator Allan Bani-Odeh, who was executed by
the PA on Saturday afternoon. A second collaborator, Magdi Mikkawi, was
also executed by a firing squad. The two were found guilty of working with
Israeli security agencies.
At the time of Allan=92s arrest in December 2000, Darshan-Leitner wrote to
PA Minister of Justice Freih Abu Medein, demanding the right to represent
Allan during his trial.=20
Abu Medein responded to the request, telling Darshan-Leitner that the
request would be seriously considered. The PA court however moved forward
and the suspects were sentenced to death in a two-hour legal proceeding.
In the wake of the short trial, Darshan-Leitner sent a letter to Avi
Dichter, the director of the GSS, insisting that the security service take
immediate action to save the life of Bani-Odeh. The GSS denied that Odeh
was its agent and that Israel was engaged in an official campaign to
assassinate Arab terrorists. This past week, however, the Israeli
government has finally acknowledged that it does indeed have a policy of
killing suspected terrorists. Despite this, the GSS failed to undertake
any steps to save the life of Bani-Odeh.
According to Darshan-Leitner, =93These agents endangered their lives in
Israel=92s war against Palestinian terrorists operating from the PA. When
these agents are captured the Shin Bet must do for them exactly as the
government would do for any of its soldiers taken prisoner on any
battlefield by any of its enemies. The Shin Bet simply abandoned Bani-Odeh
to the Palestinian security forces. Despite all high-level meetings being
conducted between Israel and the PA, the fate of the Shin Bet agent
Bani-Odeh was never placed on the agenda nor made a priority.=20
=93The Palestinian minister of Justice assured me that either myself or
another attorney from the PA would be allowed to represent Bani-Odeh in
the court hearing and that he would receive a fair trial. Yet, Bani-Odeh
was sentenced to death in a capital crime proceeding that took only a few
hours and in which he had no right of appeal Hamas activist stood outside
the courtroom door and chanted =91Death to Bani-Odeh. Now the world can see
that the PA IS a =91banana republic=92 with a brutal justice system that
completely disregards human rights. One must wonder where are the
international organizations like Amnesty International, Middle East Watch,
B=92tselem, which made no effort at all to save Bani-Odeh.=94=20=20

in the funeral service for a slain Tanzim terrorist killed in clashes by

Israel Television senior correspondent Ehud Ya'ari reported on the
evening news tonight that as part of the "progress" in the talks,
Israel has now offered the Palestinians that in return for Israeli
withdrawal to the 1967 borders that the passage linking between the
Gaza Strip and the West Bank have Palestinian control but NOT
Palestinian sovereignty.
The Israelis explained that before 1967 there was no link between the
Gaza Strip and the West Bank so the Palestinians should be willing to
accept this "compromise".

Hang-glider suicide squads poised to hit Israeli border

A PALESTINIAN terrorist group is feared to be planning suicide attacks using
powered hang-gliders to destabilise Israel in the run-up to next month's
elections.
Israeli sources claimed last week that an extremist group run by Ahmed
Jibril, a Sandhurst-educated Palestinian, had completed training with
hang-gliders under the supervision of Iranian experts.
Glider pilots from Jibril's group, the Popular Front for the Liberation of
Palestine - General Command, may now try to use their craft to cross the
border from Lebanon, flying so low they would be undetectable by Israeli
radar, the sources said. They are believed to include 10 suicide commandos.
A report on Iranian television showed a group of pilots who had just
finished their training course. They are believed to have been drilled by
special forces from Iran's revolutionary guards in the Bekaa valley of
Lebanon and also in Iran.
"We have received instructions about a possible glider attack, but we know
there is not very much one can do to prevent these people from entering
here," said Momi Azoulai, a farmer from Zarit, an Israeli village on the
Lebanese border.
It remains to be seen whether Israel's armed forces would be able to protect
the border against such a spectacular attack. In 1987 a glider fighter,
believed to have been a member of Jibril's group, flew across the border
from Lebanon and murdered six soldiers at an Israeli military base before he
himself was killed.
The Israelis fear Jibril, who has been linked with the Lockerbie bombing of
the Pan Am airliner in 1988, may try to mount a similar attack after three
months of violence in Gaza and the West Bank. More than 350 people have
died
in the conflict, most of them Palestinians.
With hopes fading that President Bill Clinton will be able to broker a
negotiated settlement before he leaves office next Saturday, Yasser Arafat,
the Palestinian president, was due to meet Shimon Peres, the former Israeli
prime minister, last night to try to bridge differences between the two
sides. America warned its citizens against travelling to Israel or the
Palestinian territories because of "a heightened threat of terrorist
incidents".
On the Lebanese border last week, preparations were being made to repel an
air attack. Helicopters flew overhead while soldiers on motorcycles
criss-crossed the fields, ready to hunt down any airborne terrorists who
attempted to land. A senior officer said his men were "doing their best to
prevent this expected glider attack".
Some people were unconvinced by the military's claims about its state of
readiness. One Israeli who lives in the border area and works closely with
the armed forces claimed they had become "lazy, fat and indifferent" since
Israel's withdrawal from south Lebanon last May.
A report released by the army claimed the armed forces could have prevented
the kidnapping of three Israeli soldiers three months ago by Syrian-backed
Hezbollah guerrillas.
Many officers are privately concerned about how Ehud Barak, the Labour
prime
minister, would react to an attack from Lebanon. "The prime minister might
use it as a pretext for disproportionate retaliation directed at the Syrian
army in Lebanon," said one senior officer. "This might lead to an escalation
and possibly the postponement of the elections."
With latest polls showing Barak still far behind Ariel Sharon, leader of the
right-wing Likud party, ahead of the February 6 election, some believe such
a military operation would be the only way for the prime minister to hold on
to power.
There is a precedent: in the run-up to the 1981 election, Menachem Begin
was
also trailing badly in the polls. There followed a startling Israeli attack
on an Iraqi nuclear reactor that helped him to victory.

convicted of providing Israel with information that led to the killing of
Palestinian activists. Human rights workers criticised the executions,
believed to be the first of their kind, saying the men had no lawyers or
right of appeal.

Pope Warns Of Mideast Spinning Out Of Control
Pope John Paul, in his yearly "state of the world" address, said Saturday
that the Middle East crisis risked spinning out of control and warned that
anything could happen unless Israelis and Palestinians learned mutual
respect. The Pope, addressing diplomats from some 175 countries
accredited to the Vatican, also said that respect for the environment and the
proper use of scientific advances would be vital in the new millennium or the
world could become "unlivable."
In his comments on the Middle East, the 80-year-old Pontiff appeared to be
more critical of Israel than of the Palestinians but the tone of his address
was one of deep and general concern. Referring to the violence in which
more than 360 people, mostly Palestinians, have been killed since
September, the Pope said no one should be resigned to the fact that "a kind
of guerrilla warfare has become an everyday event." He spoke of "the
persistence of injustice, the contempt for international law or the
marginalisation of Holy Places and the requirements of the Christian
communities."
Saying it was "time to return to the principles of international legality," he
listed these as the banning of the acquisition of territory by force, the right of
people to self-determination and respect for UN resolutions and accords.
Principles of international law had to be respected, the Pope said,
"otherwise, anything can happen: from unilateral rash initiatives to an
extension of violence which will be difficult to control." He added, "Israelis

Beijing And Moscow To Sign Pact
China and Russia are negotiating their first political treaty since an ill-fated
peace and friendship pact at the outset of the Cold War, united this time by
a desire to counter U.S. preeminence in world affairs and oppose U.S.
proposals for building a missile defense shield.
Diplomats and Russian media reports said the treaty is likely to be signed in
the middle of the year, when Chinese President Jiang Zemin travels to

entered into a political accord in decades and reinforces an assessment by
many Russian and Chinese experts that Moscow and Beijing are enjoying
their closest ties ever, even better than in the days of the Sino-Soviet alliance
